Banning additional cannabinoids: What does it mean for the market and our customers?
As of July 1, 2024, a new ban has come into effect that affects the following cannabinoids:
HHC-P, THC-B, THC-JD, Delta-8-THC, Delta-10-THC, THC-O.
This ban was enacted due to concerns about their psychoactive effects and potential health risks. We believe that such restrictions are not always the most effective solution and appeal to the need for regulation and quality control rather than a total ban.
Despite these limitations, we have a new cannabinoid on offer 10-OH-HHC, available in the form of flowers, vape pens and cartridges. This cannabinoid offers similar benefits to HHC, but is not yet regulated.
What is 10-OH-HHC?
10-OH-HHC (10-hydroxy-hexahydrocannabinol) is a new and promising cannabinoid, which is characterized by a different chemical composition and effects compared to more well-known cannabinoids. Chemically, it is a hydrogenated derivative of HHC, which is a stable and less reactive form of THC.
Properties and Effects:
- Stability: Hydrogenation makes 10-OH-HHC more stable and less prone to oxidation than THC.
- Psychoactivity: Offers mild psychoactive effects, often described as similar to previous HHCs and HHCs, less intense than THC
- Legality: It is currently unregulated and legal in many jurisdictions, making it an attractive alternative to banned cannabinoids.

So what does regulation look like?
Fortunately, it's starting to look like lawmakers are realizing that prohibition isn't the optimal, long-term solution. The above-mentioned cannabinoids have been included in the list of addictive substances regulated by the Act on Addictive Substances with effect from 1 July 2024. There is a fine for sale and possession, and even a criminal rate for larger amounts. But that should change. A law that should include cannabinoids, including THC up to a concentration of 1% and HHC from the total weight of the product, on the list of psychomodulating substances, recently passed the House of Representatives.
The law should, if nothing changes take effect 1.1. 2025.
The substances on the list will no longer be banned, but regulated.
I.e:
- The manufacturer must ensure that unit packs are labeled "psychomodulatory substance".
- The implementing legislation establishes the technical requirements for the composition, appearance, quality and properties of psychomodulating substances.
- The amount of psychomodulating substance in the package will be limited
- It must not contain foreign chemical substances.
- Products must be labeled so that the consumer receives all important information, including dosage or health and safety warnings.
- Sales should only be allowed in specialized stores dedicated to the sale of these substances and related products.
- Sales to minors should be prohibited.
- Sales through vending machines are also to be prohibited.
- In the case of "distance" (online) sales, the seller will be required to verify the buyer's age (similarly to alcohol and tobacco).
- The sale of substances to other countries, sales "at a distance" (through online e-shops) should be prohibited.
- It should be possible to export only within the framework of a special permit (import permit or confirmation of the relevant state authority of the country).
- It is also expected to introduce a consumption tax on these substances, which will be revenue for the state budget.
- Advertising whose aim or direct or indirect effect is the promotion of psychomodulating substances is prohibited
We consider the biggest positive change to be the fact that products of dubious quality and origin will no longer be sold, often in vending machines or convenience stores, often to minors. Not only is meaningful regulation needed, but we see it as a step closer to the overall legalization of cannabis.
